AG LAXALT SUPPORTED RED FLAG LAWS IN SECRET REPORT

Attorney General Adam Laxalt spoke out in 2015 against so called “Red Flag” laws that would allow a judge to strip a person of their 2nd Amendment Rights based solely on the testimony of a family member, associate or law enforcement official without any metal health expert testimony. At the time, Laxalt compared Red Flag laws to “Pre-crime” as in the 2002 movie Minority Report. But in 2018, Laxalt’s office released a school safety report that recommended funding and passage of such a law in Nevada.

Following several school mass shootings, Nevada Attorney General Adam Laxalt issued a school safety report with dozens of recommendations including his support for so-called Red Flag Laws and “MOST or Mobile Out Reach teams made up of law enforcement, social workers and/or nurses to evaluate people’s metal health allowing them to detain and disarm people they feel are a threat to themselves or others.

The study issued July 2018, on page 24, reads “Attorney General Recommends that every county consider whether MOST programs should be established”

Laxalt’s report describes Red Flag laws as “allowing law enforcement officers, prosecutors, and or family members to petition the courts for civil orders authorizing the temporary seizure of firearms from the custody of persons who have demonstrated, through specific speech or actions, that they pose a serious threat of violence to themselves or others.”

Laxalt’s report states on page 22 “The Attorney General Recommends that the Nevada legislature study the impact of Red Flag laws in other states and consider enacting similar laws in Nevada as early as the 2019 legislative session.”

The Nevada Fire Arms Coalition responded to Laxalt’s report saying “We oppose any and all laws and regulations that infringe on a person’s rights without due process as describe in the Constitution.”  

After Sisolak signed a red flag law in 2019, lawsuits were filed to block it from going into effect. Attorney Adam Laxalt refused to lift a finger to help in those red flag lawsuits.
