Last week, 360 News served the Clark County Coroner and the Southern Nevada Health District with a Public Records Request for copies of all CV19 Death certificate with deceased names redacted.
Yesterday, 360 received a response from:
Heather Anderson-Fintak, Esq. Associate General Counsel, Legal Department, Southern Nevada Health District:
“Generally, birth and death certificates are to be maintained as confidential. NRS 440.125 In order to obtain a death certificate, the requestor must have a direct and tangible interest. NRS 440.650(2) The state’s regulation further defines a direct and tangible interest to mean a direct or legal relationship, or a requirement imposed by law. NAC 440.040(2). Therefore, the Southern Nevada Health District will not provide the requested death certificates based upon a communicable disease identifier.”
360 shot back:
- You’ve made information obtained from the death certificates public
- You’ve provided the Death Certs to the CDC
- The public has an expressed interest in the information
- We directed that the names on the Death Certs could be redacted
- certainly with the pandemic and the lock downs there is an overriding interest in releasing the data for scientific and policy review.
