NV AG AARON FORD SUES TRUMP TO PROTECT SNAP FOR IMMIGRANTS

December 6, 2025

By Andrew Smith

Nevada Attorney General Aaron Ford is suing the Trump administration on behalf of the State of Nevada in a national legal battle aimed at preserving federal food assistance for immigrants (SNAP). Ford joined twenty two other Democratic attorneys general and the District of Columbia that seeks to block the Trump administration’s move to end SNAP benefits for non-citizens. The case was filed in the U.S. District Court for the District of Oregon, State of New York et al. v. Rollins.

According to the Federal government, the average Monthly SNAP benefit in 2025 is $192 per person. According to The Economic Policy Innovation Center, a think tank, about 18,000 non-citizens in Nevada are currently receiving SNAP benefits totaling $41, million per year.

In an April 2025 poll, 60% of Dems opposed giving government benefits to illegal immigrants. Dems deny SNAP benefits go to illegal aliens.

Ford argues that new USDA guidance unlawfully narrows eligibility for the Supplemental Nutrition Assistance Program and violates the Administrative Procedure Act. Their position is simple. They want federal food aid to continue flowing to non-citizens even as the Trump administration moves to restrict benefits to citizens and a limited class of qualified immigrants.

Ford’s decision instantly aligns Nevada with some of the most aggressive liberal attorneys general in the country. They are using state resources to fight a federal policy that places citizens first in the distribution of taxpayer funded aid. The lawsuit claims the administration acted too quickly and that states face administrative challenges if benefits for non-citizens are cut off.

We reached out to the Office of Attorney General Aaron Ford and requested comment on why Nevada joined this lawsuit and how he justifies this decision while running for governor. His office has not yet responded.

But Ford’s priorities are clear: Rather than focus on issues that impact Americans and Nevadans, he is fighting to protect federal food benefits for people who are not American citizens. They see a gubernatorial candidate siding with foreigners while Nevada continues to deal with public safety concerns, strained social services, and border related pressures.

Voters will have to judge whether Ford’s decision to use Nevada’s name in a partisan lawsuit to preserve benefits for non-citizens reflects the leadership he claims to offer the state.
