Nevada Ethics Commission Extorting Lombardo?

Nevada Ethics Commission Extorting Lombardo?

June 7,2023

Back in October 2021, Bernie Sanders derelict, Matthew DeFalco, filed an ethics complaint against Sheriff Lombardo for wearing his police uniform in campaign ads. The Nevada Ethics Commission is solely made up of Sisolak and Dem appointees, which may explain why they never investigated Sisolak’s corruption and are only now coming after Gov. Lombardo after he vetoed Dems’ legislation. The ethics hearing was triggered on May 30, 2023, by the committee of Sisolak appointees threatening Lombardo with fines totaling $1.6 million.

The complaint cites

NRS 281A.400(2)

Using his position in government to secure or grant unwarranted privileges, preferences,exemptions or advantages for himself,any business entity in which he has a significant pecuniary interest, orany person to whom he has a commitment in a private capacity.

NRS 281A.400(7)

Using governmental time, property,equipment or other facility to benefit his significant personal or pecuniary interest, orany person to whom he has a commitment in a private capacity. (Some exceptions apply)

This subsection does not prohibit:

      (a) A limited use of governmental property, equipment or other facility for personal purposes if:

             (1) The public officer or employee who is responsible for and has authority to authorize the use of such property, equipment or other facility has established a policy allowing the use or the use is necessary as a result of emergency circumstances;

             (2) The use does not interfere with the performance of the public officer’s or employee’s public duties;

             (3) The cost or value related to the use is nominal; and

             (4) The use does not create the appearance of impropriety;

Clearly the Sheriff of Clark County is a 24 hour 7 day a week elected position. Sheriff Lombardo was an elected civilian and not a sworn officer at the time he ran for governor. Lombardo paid for his own uniforms, so LVMPD did not incur any costs for his uniforms. His role and work experience as sheriff of Clark County were significant issues for voters to consider when electing him for governor. As such, some voters saw it as a negative, and some saw it as a positive.

BTW, I saw then-Sheriff Lombardo at numerous events during the 2022 campaign, and not once did I see him wear his uniform to a campaign event.

In fact, it is the timing of the Nevada Ethics Commission bringing these charges in the middle of the legislative session that stinks of partisanship and is highly inappropriate. The time to have brought such charges was two years ago. Their refusal to investigate Sisolak’s countless scandals just demonstrates just how outrageous this attack on Gov. Lombardo is today.

The Nevada Ethics Commission is threatening the sitting governor of Nevada with a $1.6 million fine as he considers vetoing bills with tons of cash for Democratic unions and interest groups. That’s called extortion. And it demands an investigation into the timing of these charges by this partisan-laced committee.
