GOV. SANDOVAL AT ODDS WITH ATTORNEY GENERAL LAXALT OVER DECISION NOT TO ADDRESS ESA IN SPECIAL SESSION

Yesterday, Gov. Sandoval announced he would not, in next week’s special session, address the ESA (Education Saving Account) funding mechanism issue broad up by the Nevada Supreme Court last week which essentially puts the program on hold possible, for ever if not addressed next week. The Gov. has announced a special legislative session to fund the Raiders Stadium with $750 million in new taxes, an expansion of the Las Vegas Convention Center with an additional $400 million in new taxes and raise the car registration fees by over $40 million a year as a payoff to Democrats. But he refuses to fund the ESA program putting him at odds with many in his party, including the Attorney General Adam Laxalt who has fought ad won the legal battle in the Nevada Courts.

Attorney General Laxalt’s statement:

“there is only one step left to take in order to make the vision of educational choice a reality for thousands of Nevada families. The Court ruled against the State on a small funding issue that was not even debated or contentious when this bill was passed. Fortunately, the Supreme Court has made crystal clear that ESAs are constitutional and that the Legislature can fix this funding technicality and allow for the implementation of ESAs statewide”

The Nevada Supreme Court decided last week that the ESA program, which is basicly a voucher program providing up to $5,700 per student to use at their choice of private schools, is constitutional.
