A Federal Judge in upstate New York, granted a temporary restraining order against a State of New York Health Department from enforcing vaccine mandates where a person exercises their religious object. U.S. Federal Judge David Hurd issued the order this week after health care workers sued the state of New York.

The lawsuit was filed by 17 health care workers, including Doctors and nurses, alleging the vaccine mandate issued by the State of New York “nullifies federal anti-discrimination laws for “sincere religious exemptions” granted Under Title VII of the Civil Rights Act of 1964.

Attorney Christopher Ferrara, who works for the Thomas Moore Society, said “What New York is attempting to do is shut any escape hatch from an unconstitutional vaccine mandate.”

Non Profit Public advocates, The Thomas Moore Society, said “restoring respect in the law for life, family and religious liberty”.

Under Title VII of the Civil Rights Act, “employment discrimination based on race, color, religion, sex and national origin” is forbidden.”

The Plaintiffs are not Anti-vaxers, but Health Workers seeking choice” Ferrara said.

The State of New York has until Sept 22, 2021 to respond.
